General Terms and Conditions

Preamble

These General Terms and Conditions (hereinafter "GTC") govern the contractual relationships between Rachat Collec (hereinafter "we", "us", "our") and any natural or legal person (hereinafter "you", "your", "the Seller") wishing to sell their collectibles (Pokémon, LEGO, Video Games, POP, Skylanders, etc.) via the website rachatcollec.ch (hereinafter "the Site").

By using our estimation and buyback services, you accept these GTC without reservation. We invite you to read them carefully.

Estimation Service

We offer a free and fast estimation service for your collections. To obtain an estimate, you must:

1. Select the category of items you wish to sell.
2. Precisely identify each item using the information available on the Site (name, number, condition, etc.).
3. Fill out the dedicated estimation form by adding each item and specifying its condition (Loose, Used, New, Near Mint, Excellent, Good, etc., depending on the category).
4. Provide clear and sharp photographs of each item (front/back if applicable), in accordance with the guides present on the Site. The quality of the photos is essential for an initial assessment.
5. Submit your request via the completed form.

The estimate provided is an initial buyback offer, based on the information and photos you have provided. It is indicative and non-binding on your part until the physical verification has taken place.

You undertake to provide accurate and complete information on the condition and authenticity of your items. Any erroneous or misleading information may lead to a revision or cancellation of the buyback offer.

Offer Validation and Verification

After receiving our initial estimate, if you wish to proceed, you must send us your items for physical verification. The methods (postal shipment at your expense, in-person drop-off, or collection by us for large collections) will be defined by mutual agreement.

Upon receipt, we will verify the conformity of the items with the information and photos provided during the estimation request (authenticity, condition, completeness, functionality for video games).

If the items are deemed compliant, the initial buyback offer is confirmed. If significant differences are noted (poorer condition, incomplete item, non-functional, counterfeit), we reserve the right to propose a new adjusted buyback offer or to cancel the transaction. In the event of cancellation by us or your refusal of the new offer, the items will be returned to you at your expense, or can be collected according to the agreed methods.

Payment

Once the buyback offer is confirmed after physical verification and accepted by you, we undertake to proceed with the payment of the agreed amount as soon as possible according to the agreed method.

The transfer of ownership of the items takes place at the time of full payment.

Seller's Responsibilities

• Guarantee the authenticity of the items offered for sale.
• Describe the condition of the items accurately and honestly.
• Ensure that the items (especially LEGO and Video Games) are complete and functional, unless explicitly stated otherwise and accepted by us.
• Carefully pack the items for shipment to avoid any damage during transport. The Seller is responsible for the items until they are received and verified by us.

Personal Data

Personal information collected as part of our services is processed in accordance with our Privacy Policy and current data protection legislation. It is necessary for managing your estimation request and the buyback transaction.

Applicable Law and Disputes

These GTC are subject to Swiss law.

In the event of a dispute, the parties shall endeavor to find an amicable solution. Failing this, the competent courts shall be those of the District Court of Lausanne, canton of Vaud, Switzerland.

Modification of GTC

We reserve the right to modify these GTC at any time. The applicable conditions are those in force on the date of submission of your estimation request.
